These User Terms of Service (the “User Terms”) govern your access and use of Zapoj Zsuite tools and platforms (the “Services”). Please read them carefully. Even though you are signing onto an existing organization, these User Terms apply to you as a user of the Services. We are grateful you’re here.

These User Terms are Legally Binding These User Terms are a legally binding contract between you and us. As part of these User Terms, you agree to comply with the most recent version of our “Acceptable Use Policy”, which is incorporated by reference into these User Terms. If you access or use the Services, or continue accessing or using the Services after being notified of a change to the User Terms or the Acceptable Use Policy, you confirm that you have read, understand and agree to be bound by the User Terms and the “Acceptable Use Policy”. “We”, “our” and “us” currently refers to the applicable Zapoj entity in the Contract .

You are an Authorized User on a Zsuite Controlled by a “Customer” An organization or other third party that we refer to in these User Terms as “Customer” has invited you to a Zsuite (i.e., a unique domain where a group of Users may access the Services provided by Zsuite). If you are joining one of your employer’s Zsuite, for example, Customer is your employer.

Customer has separately agreed to our “Customer Terms of Service” or entered into a written agreement with us (in either case, the “Contract”) that permitted Customer to create and configure a Zsuite so that you and others could join (each invitee granted access to the Services of Zsuite, including you, is an “Authorized User”). The Contract contains our commitment to deliver the Services to the Customer, who may then invite Authorized Users to join its Zsuite. When an Authorized User (including, you) submits content or information to the Services, such as Contact Management, Member Management , Critical Event Management and Staff Scheduling (“Customer Data”), you acknowledge and agree that the Customer Data is owned by Customer and the Contract provides Customer with many choices and control over that Customer Data. For example, Customer may provision or deprovision access to the Services, manage permissions in Contact Management or Critical Event Management, Providing access per various types of features and these choices and instructions may result in the access, use, disclosure, modification or deletion of certain or all Customer Data. Please check out our Help Center pages for more detail on our different Service plans and the options available to Customers.

AS BETWEEN US AND CUSTOMER, YOU AGREE THAT IT IS SOLELY CUSTOMER’S RESPONSIBILITY TO (A) INFORM YOU AND ANY AUTHORIZED USERS OF ANY RELEVANT CUSTOMER POLICIES AND PRACTICES AND ANY SETTINGS THAT MAY IMPACT THE PROCESSING OF CUSTOMER DATA; (B) OBTAIN ANY RIGHTS, PERMISSIONS OR CONSENTS FROM YOU AND ANY AUTHORIZED USERS THAT ARE NECESSARY FOR THE LAWFUL USE OF CUSTOMER DATA AND THE OPERATION OF THE SERVICES; (C) ENSURE THAT THE TRANSFER AND PROCESSING OF CUSTOMER DATA UNDER THE CONTRACT IS LAWFUL; AND (D) RESPOND TO AND RESOLVE ANY DISPUTE WITH YOU AND ANY AUTHORIZED USER RELATING TO OR BASED ON CUSTOMER DATA, THE SERVICES OR CUSTOMER’S FAILURE TO FULFILL THESE OBLIGATIONS. ZAPOJ MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO YOU RELATING TO THE SERVICES, WHICH ARE PROVIDED TO YOU ON AN “AS IS” AND “ AS AVAILABLE” BASIS.

You Must be Over the Legal Age To the extent prohibited by applicable law, the Services are not intended for and should not be used by anyone under the age of sixteen. You represent that you are over the legal age and are the intended recipient of Customer’s invitation to the Services. You may not access or use the Services for any purpose if either of the representations in the preceding sentence is not true. Without limiting the foregoing, you must be of legal working age.

To help ensure a safe and productive work environment, all Authorized Zapoj Zsuite users must comply with our “Acceptable Use Policy” and any applicable policies established by the Customer. If you see inappropriate behavior or content, please report it to your Primary Owner or employer.

These Users Terms remain effective until Customer’s subscription for you expires or terminates, or your access to the Services has been terminated by Customer or us. Please contact Customer if you at any time or for any reason wish to terminate your account, including due to a disagreement with any updates to these User Terms or the “Acceptable Use Policy”

If we believe that there is a violation of the Contract, Users Terms, the Acceptable Use Policy, or any of our other policies that can simply be remedied by Customer’s removal of certain Customer Data or taking other action, we will, in most cases, ask Customer to take action rather than intervene. We may directly step in and take what we determine to be appropriate action (including disabling your account) if the Customer does not take appropriate action or we believe there is a credible risk of harm to us, the Services, Authorized Members, or any third parties. IN NO EVENT WILL YOU OR WE HAVE ANY LIABILITY TO THE OTHER FOR ANY LOST PROFITS OR REVENUES OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, COVER OR PUNITIVE DAMAGES HOWEVER CAUSED, WHETHER IN CONTRACT, TORT OR UNDER ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNLESS YOU ARE ALSO A CUSTOMER (AND WITHOUT LIMITATION TO OUR RIGHTS AND REMEDIES UNDER THE CONTRACT), YOU WILL HAVE NO FINANCIAL LIABILITY TO US FOR BREACH OF THESE USER TERMS. OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY BREACH OF THE USER TERMS IS ONE HUNDRED DOLLARS ($100) IN THE AGGREGATE. THE FOREGOING DISCLAIMERS WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW AND DO NOT LIMIT EITHER PARTY’S RIGHT TO SEEK AND OBTAIN EQUITABLE RELIEF.

Zapoj Zsuite product intended for use by businesses and organizations and not for consumer purposes. To the maximum extent permitted by law, you hereby acknowledge and agree that consumer laws do not apply. If however any consumer laws (e.g., in Australia, the Competition and Consumer Act 2010 (Cth)) do apply and cannot otherwise be lawfully excluded, nothing in these User Terms will restrict, exclude or modify any statutory warranties, guarantees, rights or remedies you have, and our liability is limited (at our option) to the replacement, repair or resupply of the Services or the pro-rata refund to Customer of pre-paid fees for your subscription covering the remainder of the term.

The Users Terms, including any terms incorporated by reference into the User Terms, constitutes the entire agreement between you and us and supersedes all prior and contemporaneous agreements, proposals or representations, written or oral, concerning its subject matter. To the extent of any conflict or inconsistency between the provisions in these User Terms and any pages referenced in these User Terms, the terms of these User Terms will first prevail; provided, however, that if there is a conflict or inconsistency between the Contract and the User Terms, the terms of the Contract will first prevail, followed by the provisions in these Usdr Terms, and then followed by the pages referenced in these user Terms (e.g., the Privacy Policy). Customer will be responsible for notifying Authorized Users of those conflicts or inconsistencies and until such time the terms set forth herein will be binding.

Purpose: Agreement with a Member who joins an existing Workspace

These Member Terms of Service (the “Member Terms”) govern your access and use of Zapoj workspace productivity tools and platform (the “Services”). Please read them carefully. Even though you are signing onto an existing workspace, these Member Terms apply to you as a user of the Services. We are grateful you’re here.

These Member Terms are Legally Binding These Member Terms are a legally binding contract between you and us. As part of these Member Terms, you agree to comply with the most recent version of our “Acceptable Use Policy”, which is incorporated by reference into these Member Terms. If you access or use the Services, or continue accessing or using the Services after being notified of a change to the Member Terms or the Acceptable Use Policy, you confirm that you have read, understand and agree to be bound by the Member Terms and the “Acceptable Use Policy”. “We”, “our” and “us” currently refers to the applicable Zapoj entity in the Contract .

You are an Authorized Member on a Workspace Controlled by a “Customer” An organization or other third party that we refer to in these Member Terms as “Customer” has invited you to a workspace (i.e., a unique domain where a group of Members may access the Services, as further described in our Help Center pages). If you are joining one of your employer’s workspaces, for example, Customer is your employer.

Customer has separately agreed to our “Customer Terms of Service” or entered into a written agreement with us (in either case, the “Contract”) that permitted Customer to create and configure a workspace so that you and others could join (each invitee granted access to the Services, including you, is an “Authorized Member”). The Contract contains our commitment to deliver the Services to Customer, who may then invite Authorized Members to join its workspace. When an Authorized Member ( including, you ) submits content or information to the Services, such as messages or files (“Customer Data”), you acknowledge and agree that the Customer Data is owned by Customer and the Contract provides Customer with many choices and control over that Customer Data. For example, Customer may provision or deprovision access to the Services, manage permissions in Groups , retention and export settings, Providing access per various types of channels and these choices and instructions may result in the access, use, disclosure, modification or deletion of certain or all Customer Data. Please check out our Help Center pages for more detail on our different Service plans and the options available to Customer.

These “Customer Terms” Form a Part of a Binding “Contract” These Customer Terms (or, if applicable, your written agreement with us) and any Order Form(s) (defined below) together form a binding “Contract” between Customer and us. If any terms in the “Customer-Specific Supplement” apply to Customer (e.g., if Customer is a government entity), those terms are also incorporated herein by reference and form part of the Contract. “We,” “our” and “us” refers to the applicable Zapoj entity in the section entitled “Which Zapoj Entity is Customer Contracting With?” below.

If you purchase Zapoj Plan subscription(s), create an account with Zapoj Product invite users to Zsuite & Members to Workspaces, or use or allow use of Zapoj products after being notified of a change to these Customer Terms, you acknowledge your understanding of the then-current Contract and agree to the Contract on behalf of Customer. Please make sure you have the necessary authority to enter into the Contract on behalf of the Customer before proceeding.

Who is “Customer”? (Hint: There can be only one) “Customer” is the organization that you represent in agreeing to the Contract.

If you signed up for a plan using your corporate email domain, your organization is Customer, and Customer can modify and re-assign roles on your in either Zsuite or workspace (including your role) and otherwise exercise its rights under the Contract. If Customer elects to replace you as the representative with ultimate authority for the Zapoj products, we will provide you with notice following such election and you agree to take any actions reasonably requested by us or Customer to facilitate the transfer of authority to a new representative of Customer.

Individuals authorized by Customer to access the Zapoj Products Services (an “Authorized User”) may submit content or information to the Services, such as Notification , Incidents , messages , files , Tasks or Calls (“Customer Data”), and Customer may exclusively provide us with instructions on what to do with it. Customer will (a) inform Authorized Users of all Customer policies and practices that are relevant to their use of the Zapoj Products and of any settings that may impact the processing of Customer Data; and (b) ensure the transfer and processing of Customer Data under the Contract is lawful.

We may share information about our future product plans because we like transparency. Our public statements about those product plans are an expression of intent, but do not rely on them when making a purchase. If Customer decides to buy our Services, that decision should be based on the functionality or features we have made available today and not on the delivery of any future functionality or features.

Occasionally, we look for beta testers to help us test our new features. These features will be identified as “beta” or “pre-release,” or words or phrases with similar meanings (each, a “Beta Product”). Beta Products may not be ready for prime time so they are made available “as is,” and any warranties or contractual commitments we make for other Services do not apply. Should Customer encounter any faults with our Beta Products, we would love to hear about them; our primary reason for running any beta programs is to iron out issues before making a new feature widely available.

The more suggestions our customers make, the better the Services become. If Customer sends us any feedback or suggestions regarding the Services, there is a chance we will use it, so Customer grants us (for itself and all of its Authorized Users and other Customer personnel) an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free license to use any such feedback or suggestions for any purpose without any obligation or compensation to Customer, any Authorized User or other Customer personnel. If we choose not to implement the suggestion, please don’t take it personally. We appreciate it nonetheless.

These Zapoj Platform API Terms of Service (the "API Terms") describe your rights and responsibilities when accessing our publicly available application programming interfaces (the "APIs") and related “API documentation”. Please read them carefully. We are grateful you're here

Relationships & Definitions These API Terms, together with the Zapoj Application Developer Policy form a binding "Contract" between you and us. "We,"   "our" and "us" refers to the applicable Zapoj entity in the section entitled "Which Zapoj Entity are You Contracting With?" below, and "you," and "your," refers to the individual, company or legal entity that you represent. The Contract does not grant you any right to access or use our Products and platform (the "Services") or any of our non-public application programming interfaces, which will be governed by a separate agreement with us (e.g., our Customer Terms of Service).

Your Applications Subject to the restrictions below, we grant you a non-exclusive, worldwide, non-transferable (subject to the section titled "Assignment"), limited license to access our APIs and documentation only as necessary to develop, test and support the integration of your application (an "Application" or "App") with the Product Services. You may charge for your Application; however, you may not sell, rent, lease, sublicense, redistribute, or syndicate access to any of our APIs.

Your license to access our APIs and documentation is limited and subject to compliance with the Zapoj Application Developer Policy and Zapoj Brand Guidelines. Further, you will not: (A) access our APIs or documentation in violation of any law or regulation; (B) access our APIs in any manner that (i) compromises, breaks or circumvents any of our technical processes or security measures associated with the Services, (ii) poses a security vulnerability to customers or users of the Services, or (iii) tests the vulnerability of our systems or networks; (C) access our APIs or documentation in order to replicate or compete with the Services; (D) attempt to reverse engineer or otherwise derive source code, trade secrets, or know-how of our APIs or Services; or (E) attempt to use our APIs in a manner that exceeds rate limits, or constitutes excessive or abusive usage.

If we believe that there is a violation of the Contract that can simply be remedied by your modification or update of your Application, we will, in most cases, ask you to take direct action rather than intervene. In such instances, we may use your name, address and other contact details to contact you or provide this contact information to any third party that reasonably, in Zapoj sole determination, claims that you do not possess all of the necessary intellectual property rights. In some instances, we may directly step in and take what we determine to be appropriate action if you are not responsive, or if we believe there is a credible risk of harm to us, the Services, our customers or users or any third parties. Zapoj also reserves the right to audit your application to ensure it does not violate our terms and policies. You agree that you will cooperate with inquiries related to such an audit and provide us with proof that your application complies with our terms and policies.

Reservation of Rights You retain your ownership rights in your Application and we own and will continue to own our APIs, documentation and Services, including all related intellectual property rights therein. All of our rights not expressly granted by the Contract are hereby retained.

This Privacy Policy (hereinafter “Policy”)describes how Zapoj collects, uses, and discloses information, and what choices you have with respect to the information. Updates in this version of the Privacy Policy reflect changes in data protection laws. In addition, we have worked to make the Privacy Policy clearer and more understandable by organizing it into the sections listed in the Table of Contents below, providing a series of examples that help illustrate how the policies may be implemented by Zapoj, defining and capitalizing a few terms that are used more than once for simplicity and brevity. When we refer to “Zapoj”, we mean the Zapoj entity that acts as the processor of your information, as explained in more detail in the “How we use Information Collected” section below.


This document sets forth Zapoj’s (“We” or “Us”) privacy policy. It describes the types of personal information that we receive in the course of doing business, how we use that information, third-parties with whom we may share the information, and your choices in modifying or removing the information.

Applicability of this Privacy Policy
  1. This Privacy Policy applies to Zapoj’s critical event management platform product, ‘Zsuite; and its services, including the associated Zapoj mobile and web applications (collectively, “Applications”), Zapoj.com and other Zapoj websites (collectively, the “Websites”) and other interactions (e.g., customer service inquiries, user conferences, etc.) you may have with Zapoj. By continuing to browse the Website and/or use the Applications you hereby indicate that you have read and accepted the terms and you are now bound by the terms of this Policy. If you do not agree with the terms, do not access or use the Services, Applications Websites or any other aspect of Zapoj business. This Privacy Policy does not apply to any third-party applications or software that integrate with the Services through the Zapoj platform (“Third Party Services”), or any other third-party products, services or businesses.
  2. In addition, a separate agreement governs the delivery, access, and use of Zapoj Products and its Services (the “Customer Agreement”), including collecting, and processing of contacts, any messages, files calls (Audio or Video) (collectively, “Customer Data”). The organization (e.g., your employer or another entity or person) that entered into the Customer Agreement (“Customer”) controls their instance of the Zapoj’s services, products and applications and the associated Customer Data. If you have any questions about specific Zapoj’s service, product or application (settings and privacy practices), please contact Customer Service.
  3. This Policy applies to:
    • Individuals with whom Zapoj may have had contact for business purposes, either on our own account or on behalf of third parties or organisations.
    • Individuals who are employed by or otherwise associated with Zapoj suppliers, vendors, or professional advisors
    • Individuals who are involved in Events/seminars conducted by Zapoj.
    • Individuals with whom Zapoj has contacted during a recruitment process.
    • Individuals who have opted to receive communications from Zapojand.
    • Customers of Zapoj.
What Information we collect and receive?

Zapoj may collect and receive “Customer core Data”, “Data collected via Products” and “Information collected through our websites / Surveys/marketing events etc.


  1. Information Collected while using the Zapoj Products: Customers Core data includes Organization address, their website details, social media page information that routinely submits Customer Data to Zapoj.
  2. Information Collected while purchasing the Zapoj Products: Customers that purchase a paid version of the Products provide Zapoj (or its payment processors) with billing details such as credit card information, banking information and/or a billing address, names & address of the person who is responsible for managing Zapoj Products. Our privacy practices may vary depending on the customer usage of Zappi's Zsuite
  3. Log Data: Our servers automatically collect information when you access or use our websites, services or applications and record it in log files. This log data may include the Internet Protocol (IP) address, the address of the web page visited before using the Website or Services, browser type, and settings, the date and time on which the Services were used, information about browser configuration and plugins, language preferences, and cookie data.
  4. Information Sent by Your Device: Zapoj collects information about devices accessing the Services, including type of device, operating system, device settings, application IDs, unique device identifiers and crash data. Whether we collect some or all of this information often depends on the type of device used and its settings.
  5. Location Information: We receive information from you, your customer, and other third-parties that helps us approximate your location. We may, for example, use a business address submitted by your employer, or an IP address received from your browser or device to determine the approximate location. Zapoj may also collect location information from devices in accordance with the consent provided by your device.
  6. Information collected through our websites / Surveys: When you visit and use our websites, we may collect, retain, and use information which includes but is not limited to the following:
    • Personal information such as name, email address, and phone number.
    • The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information and, if you do not provide this information, we may not be able to provide you with the relevant service, information, or communication. Records and copies of your correspondence if you contact us. Your responses to surveys that we might ask you to complete for research purposes. Your search queries on the Website.
When do we Collect?
  1. Information collected through our Products: We collect personal data when you use our products. We also collect financial details when you purchase a Zapoj Product.
  2. Information collected through our website: Information that you provide by filling in forms on our website when registering for white papers, marketing, events, or webinars, requesting further information about our solutions, when you report a problem with our websites or when you otherwise communicate with us.
  3. Information Collected while subscribing to Zapoj Critical Event Management: While you subscribe for Zapoj Critical Event Management, we collect your personal information (including but are not limited to) in the following circumstances:
    • Personal information collected via Contact Management.
    • Personal information collected as part of granting access to Zsuite products.
    • Personal information collected via Staff scheduling.
    • Personal information collected via Critical Event Messages that are sent via Zsuite CEM services

For ease of understanding, all the information and personal data collected and retained by Zapoj are hereinafter referred to as ‘Information’ or ‘Personal Data’, or both, unless it is incompatible with the context thereof.

How We Use Information collected?
  1. Zapoj is the Data Processor i.e., a third party that processes the information on behalf of Data Controller, and its customers are the Data. The information collected by Zapoj depends on the information supplied by its customers. Zapoj may, for example, use the Services to grant and remove access of Customers to Zsuite, assign roles and configure settings, access, modify, export, share and remove Customer Data and otherwise apply its policies to the Services.
  2. The information so provided by you will be kept confidential until there is a mandate on us to process such information and personal data. We may process the data collected from you for the following purposes:
    • Customer Data will be used by Zapoj in any applicable terms in the Customer Agreement (Performance of Contract) and Customer’s use of Product functionality, and as required by applicable law.
    • To subscribe to Zapoj Critical Event Management Platform.
    • To onboard you as an employee.
    • To expand our products and services.
    • To help protect your information and prevent unauthorised access to it.
  3. We reserve the right to remove or reclaim, or deactivate your account or any accounts where it has been found that the information you have provided on behalf of any other entity or individual is incorrect or you do not have any legal claim or right to use the same.
Lawful Basis for Processing

We at Zapoj process the information provided by you only if we have a lawful basis. Our lawful basis include but are not limited to the follows:

  1. Consent: We process your data only if you have given your consent freely for the same. Where you have consented to a particular processing, you have a right to withdraw the consent at any time. You may withdraw consent by contacting us with a request using the details set out in the "Contact Information" section below.
  2. Contractual necessity: We process your personal data only when it is necessary for the performance of duties and obligations as stated in various contract. For example, if the processing is necessary in order to fulfil our commitments under the applicable terms of service.
  3. Legal Obligation: We process your data only if the use of your information is necessary for compliance with a legal obligation.
  4. Legitimate Interest: We process your data on the grounds of legitimate interest of Zapoj for example to provide our services, and to monitor the performance of the products/services and so on.

  1. For the purposes of rendering efficient services, we use automated data collection tools such as Cookies to collect certain information. “Cookies” are small text files that are placed on your hard drive by a Web server when you access our websites or avail our services.

Data Retention

Zapoj will retain Customer Data in accordance with Customer’s instructions, including any applicable terms in the Customer Agreement and Customer’s use of products and its Services functionality, and as required by applicable law. Depending on the Zapoj plan, customers may be able to customize its retention settings and apply those customized settings. The deletion of Customer Data and other use of the Products and its services by Customer may result in the deletion and/or de-identification of certain associated other information. Zapoj may retain other information pertaining to you for as long as necessary for the purposes as described in this Privacy Policy. This may include keeping your other information after you have deactivated your account for the period of time needed for Zapoj to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes and enforce our agreements.

Who would we disclose your information to, how we do that, and why?
  1. This section describes how Zapoj may share and disclose information. Customers determine their own policies and practices for sharing and disclosure of Information, and Zapoj does not control how the Customers collect, disclose and share such information.
  2. We may disclose your information to following:
    • Employees and Subsidiaries: We at Zapoj may share your information with our employees, subsidiaries on a need to know basis in order provide our services or to process the information on our behalf.
    • If we have consent: We may share and disclose information with your consent or at your direction. Where we rely on your consent to use your personal data, you have the right to restrict the disclosure as per your satisfaction and withdraw that consent at any time. Please contact us using the details in the ‘Contact information’ section of this policy.
    • Third party vendors: Zapoj provides your information and personal data to third parties such as our IT providers, services providers etc who are obligated to use the information and personal data that we share with them for the purpose of provision of their services to us in order to help us run our business.
    • Tax Authorities: The information and personal data may be shared with relevant tax, payments and customs authorities, if their procedure so requires, who may pass this on to tax authorities in other jurisdictions. Such disclosure will be restricted to disclosures required under applicable law and any other special disclosure required by such authority.
    • Regulators and Auditors: The information and personal data may also be shared with appropriate regulators, the Financial Conduct Authority, or any relevant regulatory authority where they are entitled to require disclosure; such information and personal data may be shared with auditors appointed by the providers of such products or services.
    • Corporate Affiliates : Zapoj may share Other Information with its corporate affiliates, parents and/or subsidiaries. Further, Zapoj can share the information is following circumstances:
    • During a Change to Zapoj Business: If Zapoj engages in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Zapoj assets or stock, financing, public offering of securities, acquisition of all or a portion of our business, a similar transaction or proceeding, or steps in contemplation of such activities (e.g., due diligence), some or all other Information may be shared or transferred, subject to standard confidentiality arrangements.
    • Aggregated or De-identified Data: We may disclose or use aggregated or de-identified information and personal data for any business purposes. For example, we may share aggregated or de-identified Information with prospects or partners for business or research purposes, such as telling a prospective Zapoj customer the average amount of time spent and number of notifications or incidents sent via Zsuite.
    • To Comply with Laws: If we receive a request for information, we may disclose the Information if we reasonably believe disclosure is in accordance with or required by any applicable law, regulation or legal process. Please see the “Data Request Policy” to understand how Zapoj responds to requests to disclose data from government agencies and other sources.
    • To enforce our rights, prevent fraud, and for safety: The information and personal data may also be disclosed to protects and defend the rights, property or safety of Zapoj or third parties, including enforcing contracts or policies, or in connection with investigating and preventing fraud or security issues.
Links to other Websites
  1. As states above our services can be integrated with Third Party Services, such Third-Party Services are beyond the scope of this Privacy Policy and Zapoj is not responsible for privacy practices and protection or content of such Third-Party Services.
  2. Further, our websites contain link to other websites that are not operated by Zapoj. This Privacy Policy does not cover and Zapoj is not responsible for the privacy practices, protection or content of non-Zapoj websites which we share links from our websites from time to time. We encourage you to read the privacy statements on the other websites you visit. We cannot control the content or security of such websites. We cannot be held responsible for any loss or damage incurred by a user as a result of visiting such websites. No links are intended to be, nor should be construed as, an endorsement of any kind by us of that other website.
Security Practices
  1. Zapoj takes the security of data very seriously. Zapoj works hard to protect information and personal data you provide from loss, misuse, and unauthorized access or disclosure. Zapoj has in place appropriate technological and operational security processes designed to protect the information and personal data from loss, misuse, alteration, or destruction. The information and personal data will be processed and shared in the manner mentioned above, and will be limited by need. These steps take into account the sensitivity of the such information and personal data that we collect, process, and store, and the current state of technology. Zapoj is working to get compliance with internationally recognized security certifications for ISO 27001 (information security management system) and ISO 27018 (for protecting personal data in the cloud).
  2. To learn more about current practices and policies regarding the security and confidentiality of the Services, please refer to our “Security Practices”. Given the nature of communications and information processing technology, Zapoj has taken appropriate efforts to protect the information and personal data however we cannot guarantee that such information and personal data, during transmission through the Internet or while stored on our systems or otherwise in our care, will be absolutely safe from intrusion by others. Zapoj cannot be responsible for any actions resulting from breach of security when information and personal data is supplied over the internet or any other public computer network.
  3. Further, you shall be responsible for providing accurate contact information to Zapoj at all times. You shall indemnify and hold the Zapoj harmless against any and all claims made in relation to inaccurate or wrong information provided by you to the Zapoj.
Age Limitations

Zapoj understands the importance of protecting children’s privacy, particularly in online interaction. Our Services are not directed to children under 16. If you are under the age of sixteen (16), you are not permitted to use the Webites and Services or to disclose Personal data. We do not knowingly collect personal information from children under age of sixteen (16). If we learn that we have collected the personal information of a child under sixteen (16) or if a customer becomes aware that a child below sixteen (16) years has provided their personal data, please contact us using the details in the ‘Contact information’ section of this policy in order for us to delete such personal data.

International Data Transfers
  1. Your Information and Personal Data may be transferred to and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws are different from the laws of your country and may not be as protective as those in your jurisdiction.
  2. These international transfers of your personal information are made pursuant to the appropriate safeguards such as the standard data protection clauses adopted by the European Commission. These clauses are contractual commitments between parties transferring personal data (for example, between Zapoj and its Clients, suppliers, or data processors outside the EU), bind them to protect the privacy and security of the data.
Your Rights
  1. Zapoj recognizes your right over the information and personal data shared. In accordance with the applicable data protection laws, including but not limited to GDPR, you have a right to:
    • The Right of Access: You have the right to access personal data and supplementary information. You can ask us for a copy of your personal information.
    • The Right to Rectification: You can ask us to change, update or fix your data in certain cases, particularly if it’s inaccurate.
    • The Right to Erasure: You can ask us to erase or delete all or some of your personal information (e.g., if it is no longer necessary to provide certain Services to you) without undue delay.
    • The Right to Restriction of Processing: You can ask us to stop using all or some of your personal information (e.g., if we have no legal right to keep using it) or to limit our use of it (e.g., if you think your personal information is inaccurate ).
    • The Right to Data Portability: You have the right to data portability which provides the right to receive your personal data in a structured, commonly used and machine-readable format, and have the right to transmit the same to another party.
    • The Right to Object: You have the right to object to the processing of personal data.
    • Automated individual decision-making, including profiling: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you (data subject) and so on.
    • The right to withdraw consent: You have the right to withdraw your consent at any time with effect for the future. The withdrawal of consent will not affect the lawfulness of processing based on consent before such withdrawal.
    • The right to lodge a complaint: You have the right to lodge a complaint with the supervisory authority if you are dissatisfied with the way we handle or process your personal data.

Enforcement

Zapoj privacy practices are subject to the jurisdiction of the India state Trade Commission (FTC), and as such Zapoj is subject to the investigatory and enforcement powers of the India Trade Commission.

Dispute Resolution

This Agreement shall be governed by and interpreted according to the laws of India. In the event of any dispute arising in relation to this Policy between the Parties, the Parties shall try and amicably settle the dispute within sixty (60) days from the date of receiving a notice from the other Party. Following which, the dispute shall be dealt with in accordance with the Arbitration and Conciliation Act, 1996. The arbitration award will be final and binding on both the parties. The seat of arbitration will be in _place_ and the language of arbitration shall be in English.

Changes To This Privacy Policy

Zapoj may change this Privacy Policy from time to time. Laws, regulations and industry standards evolve, which may make those changes necessary, or we may make changes to our business. We will post the changes to this page and encourage you to review our Privacy Policy to stay informed. If we make changes that materially alter your privacy rights, Zapoj will provide additional policy, via email or through our Products. If you disagree with the changes to this Privacy Policy, you should deactivate your Services account. Contact the Customer if you wish to request the removal of Personal Data under their control.

Zapoj receives requests from users and government agencies to disclose data other than in the ordinary operation and provision of the Services. This Data Request Policy outlines Zapoj policies and procedures for responding to such requests for Customer Data. Any capitalized terms used in this Data Request Policy that are not defined will have the meaning set forth in the Customer Terms of Service. In the event of any inconsistency between the provisions of this Data Request Policy and the Customer Terms of Service or written agreement with Customer, as the case may be, the Customer Terms of Service or written agreement will control.

Third parties seeking access to Customer Data should contact the Customer regarding such requests. The Customer controls the Customer Data and generally gets to decide what to do with all Customer Data.

All requests by courts, government agencies, or parties involved in litigation for Customer Data disclosures should be sent to legalprocess@zapoj.com and include the following information: (a) the requesting party, (b) the relevant criminal or civil matter, and (c) a description of the specific Customer Data being requested, including the relevant Customer’s name and relevant Authorized User’s name (if applicable), Zapoj team url, and the type of data sought.

Zapoj will notify Customer before disclosing any of Customer’s Customer Data so that the Customer may seek protection from such disclosure, unless Zapoj is prohibited from doing so or there is a clear indication of illegal conduct or risk of harm to people or property associated with the use of such Customer Data. If Zapoj is legally prohibited from notifying Customer prior to disclosure, Zapoj will take reasonable steps to notify Customer of the demand after the nondisclosure requirement expires.

  • comply with all applicable laws and governmental regulations, including, but not limited to, all intellectual property, data, privacy, and export control laws, and regulations promulgated by any government agencies, including, but not limited to, the U.S. Securities and Exchange Commission, and any rules of any national and other securities exchanges;
  • Upload and disseminate only Customer Data to which Customer owns all required rights under law and under contractual and fiduciary relationships (such as proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements) and do so only consistent with applicable law;
  • Use commercially reasonable efforts to prevent unauthorized access to or use of the Services;
  • Keep passwords and all other login information confidential;
  • Monitor and control all activity conducted through your account in connection with the Services;
  • Promptly notify us if you become aware of or reasonably suspect any illegal or unauthorized activity or a security breach involving your accounts or teams, including any loss, theft, or unauthorized disclosure or use of a username, password, or account; and
  • Comply in all respects with all applicable terms of the third-party applications, including any that Customer elects to integrate with the Services that you access or subscribe to in connection with the Services.
  • Permit any third party that is not an Authorized User to access or use a username or password for the Services;
  • Share, transfer or otherwise provide access to an account designated for you to another person;
  • Use the Services to store or transmit any Customer Data that may infringe upon or misappropriate someone else's trademark, copyright, or other intellectual property, or that may be tortious or unlawful;
  • Upload to, or transmit from the Services any data, file, software, or link that contains or redirects to a virus, Trojan horse, worm, or other harmful component or a technology that unlawfully accesses or downloads content or information stored within the Services or on the hardware of Zapoj or any third party;

We take the security of your data very seriously at Zapoj. As transparency is one of the principles on which our company is built, we aim to be as clear and open as we can about the way we handle security.

We place strict controls over our employees’ access to the data you and your contacts and users make available via the Zapoj Platform, as more specifically defined in your agreement with Zapoj covering the use of the Zapoj Products (“Customer Data”). The operation of the Zapoj services requires that some employees have access to the systems which store and process Customer Data. For example, in order to diagnose a problem you are having with the Zapoj services, we may need to access your Customer Data. These employees are prohibited from using these permissions to view Customer Data unless it is necessary to do so. We have technical controls and audit policies in place to ensure that any access to Customer Data is logged.

All of our employees and contract personnel are bound to our policies regarding Customer Data and we treat these issues as matters of the highest importance within our company.

Zapoj conducts background checks on all employees before employment, and employees receive privacy and security training during onboarding as well as on an ongoing basis. All employees are required to read and sign our comprehensive information security policy covering the security, availability, and confidentiality of the Zapoj services.

The environment that hosts the Zapoj services maintains multiple certifications for its data centers, including ISO 27001 compliance, PCI Certification, and SOC reports. In addition to the work we do at the infrastructure level, we provide Administrators of the Zapoj Products with additional tools to protect their Customer Data.

Access Logging

Detailed access logs are available to administrators of Zsuite. We log every time an account signs in, noting the type of device used and the IP address of the connection.

Organization wide Two-Factor Authentication

Administrators can require all users to set up two-factor authentication on their accounts.

Deletion of Customer Data

Zapoj provides the option for Administrators to delete Customer Data at any time during a subscription term. Within 24 hours of Primary Owner initiating deletion, Zapoj hard deletes all information from currently-running production systems . Zapoj services backups are destroyed within 14 days.*

The Zapoj services support the latest recommended secure cipher suites and protocols to encrypt all traffic in transit. Customer Data is encrypted at rest.

We monitor the changing cryptographic landscape closely and work promptly to upgrade the service to respond to new cryptographic weaknesses as they are discovered and implement best practices as they evolve. For encryption in transit, we do this while also balancing the need for compatibility for older clients.

We understand that you rely on the Zapoj Products to work. We're committed to making Zapoj Products a highly-available service that you can count on. Our infrastructure runs on systems that are fault tolerant, for failures of individual servers or even entire data centers. Our operations team tests disaster-recovery measures regularly and staffs an around-the-clock on-call team to quickly resolve unexpected incidents.

Customer Data is stored redundantly at multiple locations in our hosting provider’s data centers to ensure availability. We have well-tested backup and restoration procedures, which allow recovery from a major disaster. Customer Data and our source code are automatically backed up nightly. The Operations team is alerted in case of a failure with this system. Backups are fully tested at least every 90 days to confirm that our processes and tools work as expected.

In addition to sophisticated system monitoring and logging, we have implemented two-factor authentication for all server access across our production environment. Firewalls are configured according to industry best practices and unnecessary ports are blocked by configuration with AWS Security Groups.

We perform automated vulnerability scans on our production hosts and remediate any findings that present a risk to our environment. We enforce screens lockouts and the usage of full disk encryption for company laptops.

Zapoj maintains an extensive, centralized logging environment in its production environment which contains information pertaining to security, monitoring, availability, access, and other metrics about the Zapoj Products. These logs are analyzed for security events via automated monitoring software, overseen by the security team.

In the event of a security breach, Zapoj will promptly notify you of any unauthorized access to your Customer Data. Zapoj has incident management policies and procedures in place to handle such an event.
